An imprint is needed by almost every operator of a website. However, there are a few minor exceptions. In order to protect yourself from warnings and fines, some obligations must be fulfilled, some of which seem confusing and complicated. Does my website require an imprint?
Just about every website operator is required to create an imprint. Do you offer products or services on your website? If so, you definitely require an imprint. Your website is a website with “business-like online services”. Here, it is irrelevant whether your products are chargeable or available free of charge. Do you use your online site to write about journalistic-editorial content? If so, an imprint is mandatory. However, there is a small exception in this case: the written content must serve to form an opinion. To date, it has not been fully clarified to what extent an article is opinion-forming. Especially as a blogger, you get into uncertainties here. If you are not sure whether an imprint is obligatory for you, you better play it safe. Because if your site does not have an imprint, but you need one, you will receive a warning (e.g., by competitors) as well as fines of up to €50,000.
Another exception is the private use of websites. Sites that are used for private or family purposes do not need an imprint. Attention: However, as soon as an advertising banner (e.g., from Goolge Ads) is visible, or you work with affiliate links, an imprint is mandatory.
Which contents must be given?
Operator of the website: Personal name or company name
Complete address (post office boxes are not sufficient)
Telephone number, e-mail address and fax number, if applicable
Legal form such as GmbH, OHG, AG etc.
Depending on the legal form, shareholders, managing director and board of directors must be specified
Register entry (e.g., commercial register)
Value added tax ID, if applicable
Keep in mind that your imprint should always be up-to-date. Outdated information can also lead to a warning.
Where do I place the imprint?
It is important that your imprint should be accessible from every page. Thus, a link to the imprint must also be available on every subpage. A user should reach the imprint with a maximum of two clicks.
Take the handling of the imprint seriously. This page is not only essential for legal reasons. A proper and complete imprint conveys transparency and seriousness for your users, customers and new prospects.
